Terms of Service

Please read these Terms of Service carefully before using the StandBy mobile application operated by StandBy Comp. By downloading, accessing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using any part of StandBy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and StandBy Comp. Your continued use of the App after any modification constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use StandBy. By using the App you represent that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and are not prohibited from using the App under any applicable law. All registration information you submit must be truthful and accurate.

3. Account Registration and Security

To access most features you must register for an account. You agree to provide accurate information, maintain the security of your login credentials, and accept responsibility for all activity under your account. Notify us immediately at wil@standbycomp.com of any unauthorized access. You may not create more than one personal account or transfer your account to another person.

4. User Content

4.1 Ownership

You retain full ownership of all content you post, upload, or submit to the App, including match results, photographs, videos, and text posts.

4.2 License Grant to StandBy

By submitting content you grant StandBy Comp a non-exclusive, royalty-free, worldwide license to use, store, display, reproduce, and distribute your content solely for operating and improving the App. This license ends when you delete your content or account.

4.3 Your Responsibilities

You are solely responsible for your content. You represent that you own or have the rights to post it, that it does not violate any third-party rights, and that it complies with all applicable laws.

4.4 Content Removal

We reserve the right to remove or edit content at our sole discretion without notice if we believe it violates these Terms or may expose us to liability.

5. Firearms and Competitive Shooting Content

StandBy is designed exclusively for legal competitive shooting sports including USPSA, IPSC, 3-Gun, PCC, and related sanctioned disciplines. The following content is strictly prohibited: illegal firearm modifications, instructions for bypassing background checks, content glorifying violence, unsafe firearms handling, sale or transfer of firearms through the App, or any content violating the NFA, GCA, or applicable state law. Violations will result in immediate account termination and may be reported to authorities.

6. Prohibited Conduct

You agree not to harass or threaten other users, post defamatory or obscene content, impersonate any person or organization, create false match records, attempt unauthorized access to any system, use bots or scrapers, distribute spam or malware, or use the App for commercial purposes without prior written consent.

7. Match Data and Accuracy

Match results and statistics in StandBy are entered by users or imported from third-party sources such as Practiscore. We do not independently verify the accuracy of any match data. For official results, always refer to the sanctioning organization or match director.

8. Safety Disclaimer

StandBy is a social and performance-tracking platform, not a firearms safety resource. Nothing in the App constitutes professional firearms safety instruction or legal advice. You are solely responsible for the safe and lawful handling of all firearms. StandBy Comp is not responsible for any injury, death, or property damage arising from your use of firearms or attendance at matches.

9. Ambassador Program

Ambassador status is granted at our sole discretion and may be revoked at any time. Ambassadors receive complimentary premium access while their status is active. Ambassador status does not create an employment or partnership relationship with StandBy Comp.

10. Subscriptions and Payments

Certain features require a paid subscription. Subscriptions automatically renew unless cancelled before the renewal date. All fees are charged through Apple App Store or Google Play and are subject to their refund policies. We reserve the right to change subscription pricing with reasonable notice.

11. Intellectual Property

The StandBy name, logo, app design, and underlying technology are owned by StandBy Comp and protected by intellectual property laws. You may not copy, reproduce, or create derivative works without our prior written permission. To report a copyright infringement, contact wil@standbycomp.com.

12. Third-Party Services

The App integrates with third-party services including Supabase, Practiscore, and Apple/Google app stores. Your use of those services is governed by their respective terms. We are not responsible for the availability or content of any third-party service.

13. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STANDBY COMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR $100 USD.

15. Indemnification

You agree to defend and hold harmless StandBy Comp from any claims arising out of your use of the App, your content, your violation of these Terms, or any firearms-related activity associated with your use of the App.

16. Governing Law

These Terms are governed by the laws of the State of Iowa and applicable federal laws of the United States. You agree to submit to personal jurisdiction of courts located in Iowa for any disputes not subject to arbitration.

17. Dispute Resolution and Arbitration

17.1 Mandatory Arbitration

Any dispute arising out of these Terms shall be resolved by binding individual arbitration under the rules of the American Arbitration Association. The arbitration shall take place in Iowa.

17.2 Class Action Waiver

YOU AND STANDBY COMP AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

17.3 Informal Resolution

Before initiating arbitration, contact us at wil@standbycomp.com to attempt informal resolution. We will respond within 30 days.

18. Account Termination

We may suspend or terminate your account at any time for violation of these Terms or for conduct harmful to other users. You may delete your account at any time through Settings. Termination does not relieve you of obligations incurred prior to termination.

19. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes through the App or by email. Your continued use after notice constitutes acceptance of the revised Terms.
